TERMS AND CONDITIONS

1. Introduction

These Term and Conditions ( "Terms" ) govern the access to and use of the Philippine National Single Window ( PNSW ), an online platform that facilitates the electronic submission, processing, and exchange of trade-related documents among government agencies and accredited stakeholders.

By registering for, accessing, or using the PNSW, the User agrees to bound by these Terms.

2. Definitions

• "PNSW" refers to the national platform operated by the Government of the Philippines for trade and facilitation and regulatory processing.
• "User" refers to any individual or entity registered to access or use the PNSW
• "Regulatory Agency" refers to any government body participating in the PNSW
• "Credentials" refers to usernames, passwords, digital certificates, or authentication tokens issued to Users
• "Data" refers to all information submitted, generated, or processed through the PNSW

3. User Eligibility

Users must :

• Be duly authorized representatives of their organization
• Provide accurate and verifiable registration information
• Maintain valid licenses, permits, or accreditations required for their operations
• Comply with all applicable laws, including customs, trade, and data privacy regulations

4. User Responsibilities

Users agree to :

• Ensure accuracy, completeness, and timliness, of all submitted data
• Safeguard their login credentials and prevent unauthorized access
• Promptly report any suspected security breach
• Use the PNSW solely for lawful and authorized transactions
• Maintain updated contact and organization information

5. System Access and Availability

• The PNSW strives for continuous availability but may undergo maintenance, upgrades, or emergency downtime.
• The Government does not guarantee uninterrupted access and is not liable for delays, outages, or system errors.
• Users are responsible for ensuring their own connectivity, hardware and software compatibility.

6. Data Privacy and Confidentiality

• The PNSW processes personal and trade-related information in accordance with the Data Privacy Act of 2012 ( RA 10173 ) and relevant regulations.
• User data may be shared with authorized Regulatory Agencies strictly for regulatory, enforcement, or audit purposes.
• Users must not misuse, disclose, or distribute any confidential information obtained through the PNSW.

7. Data Ownership and Use

• Users retain ownership of the data they submit.
• By submitting data, Users grant the Government the right to process, store, and transmit such data for regulatory and operational purposes.
• Aggregated, anonymized data may be used for analytics, reporting, and policy development.

8. Prohibited Activities

Users must not :

• Attempt or bypass security controls
• Upload malicious code, malware, or harmful content
• Misrepresent information or impersonate another entity
• Use the system for fraudulent, illegal, or unauthorized activities
• Reverse engineer, copy, or modify any part of the PNSW platform

9. Audit and Monitoring

• All transactions may be logged and monitored for security, compliance, and audit purposes.
• The Government reserves the right to suspend or revoke access based on suspicious or non-compliant activity.

10. Liability and Disclaimers

• The PNSW is provided "as is" without warranties of any kind.
• The Government is not liable for :
• Losses arising from system downtime delays
• Errors in data submitted by Users
• Unauthorized access resulting from User negligence
• Users remain fully responsible for the accuracy and legality of their submissions.

11. Suspension or Termination of Access

Access may be suspended or terminated if

• The User violates these Terms
• Fraudulent or unauthorized activity is detected
• Regulatory accreditation or licenses lapse or are revoked
• The User requests account closure

12. Amendments

The Government may update these Terms at any time.Continued use of the PNSW constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of The Republic of the Philippines, including customs, trade, and data privacy regulations.
